A notice to cease and desist was issued to the World Surf League on 11-29-19 by the descendants of Ana (helu 8515:3), Kamaha (helu 5511) and Kahananui (helu 3430:1), who are land commission award holders of the area of Peahi in the moku of Hamakualoa. The descendants provided notice that the WSL have been reported as having illegally accessed, entered, and continued to occupy and conduct operations on portions of Ana, Kamaha and Kahananui kuleana land in Peahi, Maui island, specifically;
● Unauthorized access and trespassing
● Unlicensed commercial activity
● Unpermitted events within a cultural site
The Kingdom of the Hawaiian Islands hereby gave the WSL notice that the descendants of Ana, Kamaha and Kahananui are the kuleana holders of the properties described above and have been conducting clean-ups and stewardship of the area through agricultural endeavors. As the kuleana holders, the descendants of Ana, Kamaha and Kahananui hold exclusive rights to exercise its authority over the subject properties as governed under Kamehameha III 1850 self-executing Ratified Treaty with the United States of America. Under said authority, the Kingdom of the Hawaiian Islands has NOT granted permission for use of the subject properties, in whole or in part, to the WSL or any organization that the WSL is affiliated with. The WSL and any other parties or groups they represent or are otherwise affiliated with are therefore trespassing on Ana, Kamaha and Kahananui kuleana lands.
Whenever any person shall die intestate, within this Kingdom, his property both real and personal, of every kind and description, shall descend to and be divided among his heirs, as hereinafter prescribed, according to Hawaiian Civil Codes 1859; Descent of Property, Section 1447. It shall not be requisite that the intestate shall have been in actual possession of the property; it is sufficient if he had a good claim to it at the time of his death, according to Hawaiian Civil Codes 1859; Miscellaneous Laws, Section 1461. If the intestate leaves no kindred, his estate shall escheat to the Hawaiian Government, according to Hawaiian Civil Codes 1859; Miscellaneous Laws, Section 1451.
The United States, State of Hawaii, County of Maui Agents and Agencies own Oath to uphold U.S. Constitution, Laws and Treaties, makes them legally LIABLE through 42 USC §1983 for VIOLATIONS of the 1949 Geneva IV, 1907 Hague Conventions IV, USC 5 §1331, USC 18 §956, §957, §1623, §1651, §1652, §1653, §1660, §1661, §1091, §2441, §1654 and Article 6 §2 of the United States Constitution that are being committed here in the Hawaiian Islands / Sandwich Islands by use of:
1. (TMK) Tax Map Key Numbers to identify Location
2. (TMK) Tax Map Key Numbers to determine Title
3. (TMK) Tax Map Key Numbers to collect Taxes
4. (TMK) Tax Map Key Numbers to retain Jurisdiction over Internationally Protected Persons and
Internationally Protected Property
5. (TMK) Tax Map Key Numbers to Pillage, Destruct, and Appropriate Protected Persons and
Private Real Property not needed by Military Necessity
6. (TMK) Tax Map Key Numbers to authorize the carrying of deadly weapons such as Small Arms
and Light Weapons.
Therefore, committing the act of PILLAGING, DESTRUCTION AND APPROPRIATION under Rules of War 1949 Geneva IV under 18 U.S. CODE §2441 and Violating his Majesty the King of the Hawaiian Islands Kamehameha III 1850 self executing ratified Treaty with the United States of America under U.S. Constitution Article 1 §8 and under U.S. Constitution Article 6 §2.
Agents and Agencies mentioned above must comply and are subject to Kamehameha III Treaty, Constitution, Laws, Civil and Penal Codes of the Hawaiian Islands once within three miles from the low water mark near the shore of the Hawaiian Islands.
The Kingdom of the Hawaiian Islands demand that the WSL immediately cease and desist operations mentioned above on subject properties. Be advised that any existing or new event(s), operation(s) or equipment scheduled to be in the vicinity after 11/29/19 is subject to cancellation, disposal and penalties pursuant to Kamehameha III Treaties, 1852 Constitution, Civil and Penal Codes of the Hawaiian Islands.
